As regards Anonymous' comment about second cousins, I live in a state where relationships with second cousins are still considered incest -- however third cousins are called kissin' cousins.

Since she is first cousin to his mother, then they are 1st cousins once removed. In many states that is not incest, including mine. Here 1st cousins can marry, as they can without limitation in another 19 states. 6 or 7 more have allow marriage with restrictions. On the other hand, social convention, or religion can still consider this incest even where legal.
